Privacy Policy

This Privacy Policy explains how IzzyOS LLC, a Wyoming limited liability company, 1309 Coffeen Avenue, Suite 1200, Sheridan, Wyoming 82801, USA ("IzzyOS," "we," "us," or "our"), collects, uses, shares, and protects personal information when you use izzyos.com, app.izzyos.com, funnels.izzyos.com, and our pages, funnels, forms, chats, calls, text messages, emails, events, programs, and software platform (the "Services"). It is part of our Terms of Service. It covers the GDPR (EU), UK GDPR, PIPEDA (Canada), the CCPA as amended by the CPRA (California), and other US state privacy laws.

1. Who Controls Your Information

IzzyOS as controller. For our own visitors, leads, buyers, and account holders, IzzyOS LLC decides how and why your information is used.

IzzyOS as processor. When a customer of our platform uses the Services to collect and contact their own leads and customers, that customer is the controller (the business responsible for the data) and we process it only on their instructions, under our Data Processing Agreement (izzyos.com/legal/dpa). If you are a lead or customer of one of our platform customers, please contact that business to exercise your rights. We will forward your request if you ask and help them answer it.

2. Information We Collect

Information you give us. Name, email address, phone number, business name and details, answers to forms and questionnaires, messages, chat and call content, event registrations, testimonials, files and brand assets you upload, and account credentials.

Payment information. Payments are collected by our billing agent, Fame Hackers, LLC, and processed by payment processors such as Stripe, and by any financing provider you choose. We receive limited details such as your name, email, amount, and the type and last digits of your card. We do not store full card numbers.

Calls, recordings, and transcripts. When you speak with us or our AI agents by phone, we may record, transcribe, and analyze the call, as described in our Terms of Service. Recordings and transcripts are kept with the related contact record.

Information collected automatically. IP address, device and browser type, pages viewed, referring pages and campaign links (UTM tags), time on page, clicks and scroll depth, approximate location, and email open and click activity. We collect this with cookies, local storage, pixels, and similar tools described in our Cookie Policy.

Information from others. Information from our payment, scheduling, advertising, social media, and analytics partners, and from people who refer you.

Where we get it

We get personal information from you directly, automatically from your device when you use the Services, and from the partners and people named above.

Sensitive personal information

We do not ask for or knowingly collect sensitive personal information such as health, financial account, government ID, or biometric data. Please do not send it to us. Voice recordings are used only to deliver and document the call, never to identify you by your voice.

3. How We Use Information

  • To provide, operate, and personalize the Services, including AI agents that respond to you by chat, text, email, and phone.
  • To process payments, payment plans, financing, and refunds, and to prevent fraud and chargeback abuse.
  • To send transactional messages, such as receipts, login details, reminders, and service notices.
  • To send marketing emails, texts, and calls where you have consented or the law otherwise allows.
  • To measure and improve our advertising, including through the advertising pixels described in Section 6.
  • To provide support, keep records, and resolve disputes.
  • To analyze, secure, and improve the Services, including by creating aggregated, de-identified data that cannot reasonably identify you.
  • To enforce our Terms and comply with law.

4. Legal Bases (EU and UK)

We rely on: performance of a contract with you (accounts, billing, delivering the Services); our legitimate interests in running, securing, marketing, and improving our business, balanced against your rights (analytics, fraud prevention, business marketing with opt-out); your consent (marketing texts and calls, and where the law requires it, non-essential cookies and pixels); and legal obligations (tax, accounting, responding to lawful requests).

5. AI Processing and No Training

The Services use AI model providers, including Anthropic and OpenAI, and voice AI providers to generate responses, drafts, summaries, call handling, and analysis. Information is sent to them as our subprocessors only to perform the Services.

We do not use your content, your contacts' data, or your call recordings to train general-purpose AI models, and we use our main AI model providers under business terms that do not allow them to train on that data. If you choose a feature that builds something for your account alone (for example, a consistent AI likeness from photos you upload with the subject's consent), it is built only from what you provide and used only for your account.

AI output may be inaccurate. We do not use AI or other automated means to make decisions that produce legal or similarly significant effects about you without human involvement. If you believe that has happened, email privacy@izzyos.com to request human review.

6. Advertising Pixels and Analytics

Our own website and funnels use advertising pixels from Meta (Facebook and Instagram) and OpenAI to measure our ads and show our ads to people who visited us, and first-party analytics that record page views, clicks, scroll depth, and the campaign that brought you. These pixels let the ad platforms receive information such as your IP address, device, pages viewed, and actions like signing up or buying. Under California and some other state laws this can be "sharing" for cross-context behavioral advertising or "targeted advertising." See Section 9 for how to opt out, and our Cookie Policy for details.

Our platform customers may add their own pixels and tags to their own pages. Their privacy policies govern that use.

7. How We Share Information

We do not sell your personal information for money. We share it only as follows:

  • Service providers and subprocessors that help us run the Services, under contracts that limit their use of the data. Categories include hosting and databases, payment processing and financing, email delivery, SMS and voice telephony, AI model and voice AI providers, scheduling, analytics, and customer support tools. Our current list is at izzyos.com/legal/sub-processors.
  • Our billing agent and affiliated companies, for payment collection and administration.
  • Advertising platforms, through the pixels described in Section 6.
  • Platform customers, when you opt in through a customer's funnel, that customer receives your information to contact you.
  • Legal and safety: to comply with law, legal process, or government requests; to enforce our Terms; to respond to chargebacks and disputes; and to protect rights, property, and safety.
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
  • With your direction or consent.

Selling and sharing

We do not sell personal information for money, and mobile numbers and text consent are never sold or shared. Our advertising pixels (Section 6) may count as "sharing" for cross-context behavioral advertising under California law. Section 9 explains how to opt out.

8. Text Messages and Calls

When you (or a visitor opting in through a funnel) provide a phone number and consent to be contacted, we may send SMS messages and place voice calls related to the service requested, such as lead-confirmation texts, appointment reminders and reschedule notices, payment links and receipts, and follow-ups about scheduled calls or services purchased. Marketing texts are sent only with separate marketing consent.

Message and data rates may apply. Message frequency varies. Reply STOP to any message to opt out, and HELP for help. To stop calls, tell the caller or email privacy@izzyos.com. Calls may be recorded and transcribed, with notice at the start of the call.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Phone numbers and SMS consent are used only to deliver the messages the recipient opted in to receive, and are disclosed only to the messaging carriers and platform providers that transmit them on our behalf.

SMS consent is collected on two separate, optional checkboxes, both unchecked by default: one for transactional texts (account, appointment, and purchase updates) and one for marketing texts (offers, launches, and event invitations). Each is agreed to on its own and neither is required. Consent to receive texts is not a condition of creating an account, submitting a form, or buying anything. Replying STOP opts you out of both.

Marketing choices

Every marketing email we send has an unsubscribe link. Reply STOP to any text to stop texts. Consent to marketing is never a condition of purchase.

9. Your Privacy Rights

Depending on where you live, you may have the right to:

  • know about and access the personal information we hold about you;
  • correct inaccurate information;
  • delete your personal information, subject to legal retention duties;
  • receive a portable copy of it;
  • opt out of the sale or sharing of personal information and of targeted advertising;
  • limit the use of sensitive personal information (we do not collect it for that purpose);
  • object to or restrict certain processing, and withdraw consent at any time;
  • not be discriminated against for exercising your rights.

California residents. In the past 12 months we collected identifiers, commercial information, internet and network activity, approximate geolocation, audio recordings, professional information, and inferences, from the sources and for the purposes above. We do not sell personal information for money. Our advertising pixels may be "sharing" for cross-context behavioral advertising. To opt out of sale or sharing, email privacy@izzyos.com with the subject "Do Not Sell or Share." We do not knowingly sell or share the personal information of anyone under 16.

EU, UK, and Canada. You may also complain to your data protection supervisory authority: in the EU, the authority listed at edpb.europa.eu; in the UK, the Information Commissioner's Office (ico.org.uk); in Canada, the Office of the Privacy Commissioner (priv.gc.ca).

How to use your rights

Email privacy@izzyos.com with your request and where you live, or call (307) 522-1176. We will verify your identity before acting. We respond within 30 days for GDPR, UK GDPR, and PIPEDA requests and within 45 days (extendable once by 45 more) for US state requests. Requests are free unless they are clearly unfounded or excessive. You may use an authorized agent, who must show your signed permission. If we deny a request, you may appeal by replying to our decision, and we will answer the appeal within the time the law requires.

10. Data Retention

We keep personal information only as long as needed for the purposes above:

  • account data: while your account is active, and up to 30 days after a deletion request;
  • messages, call recordings, and transcripts: for as long as the related contact record exists, plus 30 days;
  • billing and tax records: 7 years;
  • consent records and audit logs: up to 2 years after account deletion, to prove consent and defend claims;
  • backups: purged on a rolling 30-day cycle.

We then delete or de-identify it.

What leads tell our customers. When a lead tells one of our customers something, like a goal, a budget or a question, we save it as a fact about that lead. We delete a fact 30 days after a newer one replaces it. When a customer deletes a lead, we delete the facts about that lead within 30 days. If a lead has had no activity for 24 months, we delete the facts about them, unless our customer chose to keep that lead. Our customers can export these facts at any time, and deleting their account deletes them. We log how many facts we delete, never what they said.

11. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, role-based access controls, audit logging, and provider security programs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We will notify you and the authorities of a personal data breach as the law requires. Report a vulnerability to privacy@izzyos.com.

12. International Transfers

We are based in the United States and our providers mostly process information in the United States. If you use the Services from outside the United States, your information is transferred there. For transfers from the EU, UK, and Switzerland we use safeguards such as the European Commission's Standard Contractual Clauses and the UK Addendum.

13. Children

The Services are for adults running businesses. No one under 18 may buy or create an account. We do not knowingly collect personal information from children under 13 (or under 16 where the law requires). If you believe a child has given us information, contact us and we will delete it.

14. Third-Party Sites and Services

Our Services link to or connect with third-party sites and services. Their own privacy policies govern their practices.

Cookies and tracking

Our Cookie Policy explains the cookies, pixels and similar tools we use and how to control them. Our website does not respond to Do Not Track browser signals.

If you do not give us your information

You do not have to give us personal information. If you do not give us the details needed to create an account, take payment, or contact you, we cannot provide the Services that need them.

15. Changes to This Policy

We may update this Privacy Policy. We will post the new version with a new "Last updated" date and, for material changes, give reasonable notice by email or through the Services.
